Ben & Jerry’s, the ice cream company, has initiated legal action against a pornographic film company for producing an X-rated video series titled “Ben & Cherry’s”, claiming it damages their wholesome image.
Attorneys representing the beloved ice cream brand argue that the sale of these adult films under a playful name establishes a connection with crude content and sullies the reputation of Ben & Jerry’s Homemade Holdings Inc.
The film studio has issued a series of films inspired by the brand’s popular flavors and even incorporated images from Ben & Jerry’s ice cream packaging on their DVD covers.
Notable X-rated titles include “Boston Cream Thigh,” “New York Fat & Chunky,” and “Peanut Butter D-Cup,” which are parodies of Ben & Jerry’s flavors like “Boston Cream Pie,” “New York Super Fudge Chunk,” and “Peanut Butter Cup.”
The lawsuit from the Vermont-based brand contends that these films would likely result in “confusion, mistake or deception” regarding the company’s trademarks.
For almost 35 years, Ben & Jerry’s has been manufacturing and distributing ice cream across 300 locations in the US and 150 worldwide.
In the past, Ben & Jerry’s has also adopted some suggestive names for its ice cream varieties, such as Schweddy Balls and Karamel Sutra.
